Claim Protocol

VA has two(2) types of programs, Service Connected compensation and Non Service Connected compensation. Service Connected Compensation is NOT income base and you can work or be a millionaire and it’s not going to affect you. The VA, IRS, and Social Security Administration are inter-linked and they talk to one another.

For Service Connected Disability

According to present day VA regulations, at any given time, any vet can do a claim for what ever they want, paper work or not to back up the claim is not mandatory. Will it get approve, don’t know, it’s a 15/85 chance.

For veterans that file within the first year of getting out all they have to provide to VA is a diagnosis of having something, physical or mental. VA knows that while we are in, we are trying to get promoted and not wanting to be sickbay commandos and that is why they are lenient.

If we wait the one(1) year and one(1) day, we need to provide three(3) things to VA.
  1. Diagnosis
  2. Nexus- link
  3. Documentation to show that the issue at hand is chronic and ongoing that originated from the Military

If you have all three, you have a strong case.

Now, for issues that are physical you get rated on pain and mobility. From those issues you can develop 2nd side effects that were caused by the original issue.
Example. You are service connected for Left knee, if you had that issue for years, it led you to change the way you walk that led to favor the other knee that then caused that knee to be bad plus your hips by this time have problems and also lower back. From all the medication that you took for the service connected issue you could now be suffering from GERD( acid reflux-burning up your esophagus/stomach). You could’ve also developed depression because you had to modify your whole life and are not as proactive as you Once used to be with your kid(s), family, and friends.

If you have taken medication for a mental condition, read the side effects and the common side effect is Erectile Dysfunction.

When someone is exposed to IED blasts, one can suffer from Traumatic Brain Injury(TBI) and the side effects are memory loss, headaches, hearing loss, and tinnitus (ringing in the ears).

For Non Service Connected Pension

1. One needs to have done 90 days of active duty( not applicable if discharge from                                                                                    military is due to issue that is currently Service Connected)
2. One of those days during a time of war
3. If under 65 years of age, you need to show that your current conditions that came from Regular life play a factor as to why you cannot work

Then you need to qualify based on your household income, THIS IS AN INCOME BASE PROGRAM. Any and all money has to be reported, example- Social Security, Unemployment, Pension from previous jobs, interest from stock/bonds, income from properties, Inheritance, Casino winnings/ Lotto
